Due Diligence
As captured in Rebecca Sittie’s (a former land registrar at the land registry division of the lands commission) article titled “Land Title Registration. The Ghanaian Experience”, she noted “A satisfactory system of land administration should give ordinary people a sense of security concerning the lands they hold and freedom from fraudulent claims, it should provide a man who lays out good money whether as a purchaser of land or as a lender against the security of a mortgage of land, with some independent means of assuring himself that he is obtaining good title and not a law suit”.
It is a fact that the land/property business in Ghana has many challenges leading to varied challenges to organizations, institutions, individuals and investors. And that is what has been aptly captured by no mean a person than the former Chief Registrar of Lands.
These are situations Cephter encountered on daily basis as we started our business in the late 90s. Which situation ignited in us the passion to dig, understand and prevent our clients from suffering these needless yet expensive challenges, hence due diligence, investigation and research became one of our core duties.
It is a fact that the lands commission is the repository of all land records in the country, hence an official confirmatory search should suffice in a land transaction, but again the words of the former chief registrar tells something else. Cause many have on the strength of these searches gone ahead to enter into transactions which have ended up in either loss of investments or litigation.
